Lucca Privacy Policy

This privacy policy provides you with information on how Lucca Software GmbH, whose head office is registered at Rosa-Bavarese-Straße 3, 80639 München (hereinafter referred to as “Lucca”), as data controller, processes your personal data (hereinafter referred to as “Personal Data”) for purposes of commercial prospecting or communication (which data, why, for how long, etc.) and the rights that you can exercise.

This privacy policy applies to: 

  • Prospects or customers who send their data to Lucca via the contact forms on its website;
  • Partners and potential partners.

This privacy policy does not apply to:

  • Processing of cookies, for which the policy is available by clicking here;
  • Data of employees who use our solutions through their employer:
    • If you are an employee, your query should be sent directly to your employer
    • If you are a customer, you can send your query to our customer Support team (unless you have signed a contract with a Lucca distributor, in which case you should contact them directly).

We process your Personal Data in compliance with the applicable regulations and particularly in line with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.

1. Personal Data processed

Lucca is required to collect and process the following categories of Personal Data: 

  • Identification data: identity, email (particularly professional email address), phone number; 
  • Data relating to the person’s professional life: job title, employer’s name.
  • Any other data that you may send us.

This data is collected directly from you or from our partners. In the latter case, our partners provide us with a guarantee that they have obtained the data legally.

2. Processing purposes

This data is processed by Lucca for purposes of commercial prospecting, communication or development of our partner network.

3. Legal basis

According to the situation, your Personal Data is processed on the basis of: 

  • The pursuit of our legitimate interests; 
  • Your consent, given when submitting a completed contact form at your initiative or when downloading one of our practical guides; 
  • The fulfilment of pre-contractual measures to provide you with our solutions (for example, if you request a demo).

4. Recipients of data and transfers

Your data may be processed by employees of Lucca or its sub-processors.

Some of our sub-processors may be based outside of the European Union and in such cases, Lucca undertakes to check that the appropriate measures are in place in order to ensure that your Personal Data is covered by an appropriate level of protection (particularly via signing the European Commission’s standard contractual clauses).

5. Data retention

Your Personal Data is retained for a period of 3 years from its collection by Lucca or from your last contact with Lucca. 

Upon expiry of this period, the data will be permanently erased or will be subject to anonymisation operations that ensure that the individual concerned is no longer identifiable. 

If you are a customer or partner of Lucca, or if you become a customer or partner, your Personal Data will be stored for longer, according to the terms of the contract signed.

6. Your rights

You have the following rights: 

  • Right to be informed: the right to obtain clear and precise information on the processing of your Personal Data;. 
  • Right to object: the right to be able to object to the processing of your data, for legitimate reasons, unless the processing is required under a legal obligation; 
  • Right to access: right to request access to your data;
  • Right to rectification: right to request that your data be rectified, supplemented or updated;
  • Right to portability: right to request that your Personal Data be sent to you in a structured, machine-readable (computer) format and to be able to send it to third parties;
  • Right to restrict processing: right to request the temporary suspension of the use of some of your data;
  • Right to erasure: right to request the deletion of your Personal Data;
  • Right to not be the subject of a decision based on automated processing, including profiling;
  • Right to decide how your data is used after your death: right to set directives for the use of your data after your death;
  • Right to file a complaint with a supervisory authority: if you believe that your rights are not being respected, you can file a complaint with a supervisory authority.
